    AFFIDAVIT OF DANIEL FUTRELL

    I , Daniel F u t r e l l , being duly sworn, depose and s t a t e thefo l lowing:

    1. I am employed as a Spec ia l Agent with the Uni ted St a t e sDepartment of J u s t i c e , Bureau o f Alcohol , Tobacco, Firearms andExplos ives (ATF), and have been so employed fo r approximate ly nine(9) years . During t h a t t ime, I su ccess fu l l y completed CriminalIn v es t i g a t o r School and New Agent Tra in ing a t the Federa l LawEnforcement Tra in ing Center in Glynco, Georgia . Pr i o r to t h a t ,was employed as a Divers ion In v es t i g a t o r for the Drug EnforcementAdmini s t ra t ion . During my ca ree r in law enforcement , I haveconducted many i n v es t i g a t i o n s i nc lud ing s e v e r a l i n v es t i g a t i o n si n to the unlawful possess ion of f i rearms and explos ive d ev ices .

    2. During my work on t h i s case , I have reviewed r ep o r t sprepared by o th e r i nves t iga to rs rega rd ing witness i n t e rv i ews ,su rv e i l l an ce and o th e r i nves t iga t ive e f f o r t s . In ad d i t i o n , I haved i sc usse d th i s i n v es t i g a t i o n with o t he r agents and o f f i ce r sinvo lved i n the case . As a r e s u l t of my persona l p a r t i c ip a t i o n int h i s i n v es t i g a t i o n , through my conversa t ions with o th e r agents andmy ana lys i s of repor t s prepared by o th e r agen t s , I am f ami l i a rwith a l l aspec t s of t h i s inves t iga t ion . As se t fo r t h below, such samples c o n s t i t u t eevidence o f cr imes .

    4. On or about January 18, 2007, the l a s t day of a trialt h a t s t a r t ed on January 9, a ju ry re tu rned v e rd i c t s convic t ingEdward Brown and Elaine Brown of consp i racy and a number o ff e d e r a l tax cr imes .

    S. The ju ry re tu rned its v e r d i c t ag a in s t Edward Brown in h isabsence. After the t h i r d day of evidenc e, January 11, 2007,Edward Brown re tu rned to h is and Ela ine Brown's j o i n t re s idence inP l a i n f i e l d , N.H., and never came back to co u r t . On January 12,2007, a f ed e ra l war ran t was i s sued fo r Edward Brown's a r r e s t basedupon h is fa i lu re to appear fo r the comple t ion of h is t r i a l .

    6. Ela ine Brown also fa i l ed to appear fo r what was to be the2

    four th day of evidence but , a f t e r a b r i e f cont inuance of theproceed ings , she re tu rned fo r the remainder of th e t r i a l . Shor t lya f t e r her convic t ion , however , she was charged with vio la t ingcondi t ions o f her r e l ease pending sen tenc ing by removing ane l ec t ro n i c moni tor ing ank le b r a c e l e t and r e tu rn in g to herre s idence where Edward Brown remained. A f ed e ra l war ran t wasi s sued fo r her a r r e s t .

    7 . On Apr i l 24, 2007, Edward Brown and Ela ine Brown were

    each sen tenced to s i x t y - t h r e e (63) months in p r i so n . Nei the rEdward Brown nor Ela ine Brown appeared fo r the sen tenc ingproceeding and the sentences ag a in s t them were imposed in t h e i rabsence.

    8. While the Browns had been fug i t ive s , o f f i ce r s of theUni ted St a t e s Marshals Serv ice have made e f f o r t s to a r r e s t them.Ouring the same per iod of t ime , the Browns had remained i n s id e theboundar ies of the proper ty on which t h e i r horne i s loca ted , andthey have p u b l i c l y s t a t ed t h e i r i n t en t i o n to fo rc i b l y r e s i s t anye f f o r t to a r r e s t them.

    9. While the Browns had been fug i t ive s , they have used anumber of publ ic forums, i nc l ud i ng , bu t not l imi ted to ,t e l ev i s ion , newspaper, magazine and rad io i n t e rv iews as well asi n t e r n e t pos t ings to p u b l i c l y d ec la re t h e i r i n t en t ion to fo rc ib lyr e s i s t any e f f o r t to a r r e s t them. They have a l so permi t t ed anumber of people who share t h e i r b e l i e f t h a t t h e re i s no l eg a l

    10. The Browns were t aken in to cus tody on October 4, 2007and a search of t h e i r proper ty was t h e r e a f t e r conducted. Duringthe course of the sea rch , mu l t ip l e f i rea rms and d e s t ru c t i v edevices were se i zed and sen t to the Bureau of Alcohol Tobacco andFirearms Laboratory fo r ana lys i s .

    11. A ll four of above named ind iv idua l s a re defendants inth e case , Uni ted St a t e s v . Ri ley , e t a l . , Cr. No. 07-189-GZS.

    12. Each of the above named four have been charged withbeing acces so r i e s a f t e r the f a c t with r e s p e c t to Edward and ElaineBrown and have a l so been charged with two co n sp i rac i e s , g en e ra l lyto impede by force and vio lence the United St a t e s Marshals Serv icefrom apprehending the Browns; one in vio la t ion of 18 U.S.C. 371and 111(a) and the other in vio la t ion of 18 U.S.C. 372.

    13. Ad d i t io n a l ly Ri ley , Gerhard and Gonzalez have beencharged with v i o l a t i o n s o f 18 U.S.C. 924(c) , posse s s i ng and usinga f i rearm in fur the rance of a crime o f vio lence .

    14. On October 10, 2007, pur suan t to the execu t ion of aFedera l Search Warrant law enforcement se ized from the Brown'sre s idence a l a rge quan t i ty of explos ive des t ruc t ive devices t h a tinc luded pipe bombs, booby t r ap devices t h a t were pipes t h a t f i r edsho t gun rounds , and cans of black powder with f u se s , many wrapped

    in n a i l s . In ad d i t i o n , p i s t o l s , r i f l e s and a l a rg e q u an t i t y ofammunition were a l so s e i zed as ev idence , much of which was sen t tothe ATF Labora tory fo r an a l y s i s , i nc lud ing DNA an a l y s i s .

    IS . On January 2, 2007, t h i s a f f i an t was n o t i f i e d by ATFLaboratory DNA Technical Leader Todd B i l l e t h a t he had obta inedsep a ra t e p a r t i a l DNA p r o f i l e s from 10 pieces of evidence t akenfrom Brown r e s id en ce . Of the p a r t i a l DNA p r o f i l e s : one DNAp a r t i a l p r o f i l e was obta ined from a pipe bomb end cap, one from

    the cap of a GoEX can of black powder with a fuse t h a t was wrappedin n a i l s , one from a can of GoEx black powder, and p a r t i a l DNAp r o f i l e s were found on s ix r i f l e s and one shotgun. One fu l l DNAp r o f i l e was obta ined from a Weatherby, Model: Vanguard, .308c a l i b e r r i f l e with s e r i a l number: VL13826. And one f u l l DNAp r o f i l e was obta ined from a Bushmaster Firearms, Model: Carbon-IS,.223 c a l i b e r r i f l e with s e r i a l number: E14761. A Firearms TraceReport of t h i s Bushmaster Firearms r i f l e shows t h a t Jason Gerhardpurchased it from Als tead Gun Shop, Alstead, NH on January 21,2007.

    16. Evidence in the case , i nc lud ing in te rv iews given to lawenforcement by two of the defendants (Ri ley and Wolffe) t ends toprove t h a t Danie l Riley, Jason Gerhard and Cir ino Gonzalez eachbrought r i f l e s in to the Browns re s idence dur ing the pendency ofthe Browns' fug i t ive s t a tu s and t h a t while on the premisespossessed , used and ca r r i ed var ious f i rearms .

    17. Evidence in the case , inc lud ing an i n t e rv iew of Rober tW o l f ~ e ' s wife , e s t a b l i s h e s t h a t Rober t Wolffe had been to theBrown's r ~ s i d e n c e dur ing the pendency of t h e i r fu g i t i v e s t a t u snumerous t imes and t h a t w h i l ~ t h e re f i r ed f i rea rms with EdwardBrown.

    18. Evidence in the case a l so e s t a b l i s h e s t h a t Danie l Ri ley ,Jason Gerhard and Rober t Wolffe were invo lved in the handl ing o fcomponents (pipe and var ious p i pe f i t t i n g s ) used in themanufacture o f d es t ru c t i v e de v i c e s ( inc lud ing pipe bombs and boobyt r ap devices made from pipe f i t t i n g s ) found on the Brown pr ope r t ya f t e r the Browns were t aken i n t o cus tody.

    19. l o u r a f f i a n t knows from t r a i n i n g and exper ience , andfrom i n format ion provided i n co n su l t a t i o n with one or moreexper ienced agen ts and /or fo ren s i c s e ro l o g i s t s , t h a t sa l i v aobta ined from o r a l Buccal samples taken from a suspec t would be ofe v i d e n t i a r y Jalue, in t h a t such samples could be ana lyzed andt e s t ed , using fo ren s i c DNA t e s t i n g t echniques , a g a i n s t the DNAobta ined from human body f l u i d evidence , such as s a l i v a , takenfrom a cr ime scene or from an ev id en t i a ry i t em . Such f o r e ns i c DNAt e s t ing would make it p o ss ib l e to draw s t rong conc lus ionsregard ing whether the body f l u id evidence found a t the crime sceneor found on the e ' J iden t i a ry i tem i s l i k e ly to have o r ig in a t ed - o rnot to have o r i g i n a t ed - from t he suspec t . Moreover, the r e s u l t sand conc lus ions drawn from fo ren s i c DNA t e s t i n g and comparison of
