IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is

pleased to order the publication of the following English translation of the Uttar Pradesh Sarvajanik Bhoo-

grihadi (Apradhikrit Adhyasiyon Ki Bedakhali) (Sanshodhan) Adhiniyam, 2007 (Uttar Pradesh Adhiniyam

Sankhya 15 of 2008) promulgated by the Governor :— . . |

further to “amend the Uttar Pradesh Public. Premises (Eviction of

Unauthorised Occupants) Act, 1972.

IT 1S HEREBY enacted in the Fifty-eighth Year of the Republic of India as

follows :-

1(1) This Act may be called the Uttar Pradesh Public Premises (Eviction of —Shorttitle,

Unauthorized Occupants) (Amendment) Act, 2007. extent and commencement

(2) It extends to the whole of Uttar Pradesh,

(3) It shall be deemed to have come into force on May 1, 1972.

Amendment of 2. In sec

section 2 of U.P. Occupants) Act, 1972, in clause (e) the following p

Act no. 22 of 1972 end and be deemed to have always been inserted, namely :—

“but does not include, the Public Premises which are under the

Administrative control of the Estate Department and which are occupied by,—

(a) a Minister of the Government of Uttar Pradesh or a person given rank of a

minister;

(b) a Member of Parliament, a Member of Legislative Assembly or the

Legislative Council of Uttar Pradesh;

(c) anon-Government organization, whether incorporated or registered or not,

(d) a political party not recognized by the Election Commission of India; -

ed under the Societies Registration Act, 1860, a trust

(e) a society register der the

registered under the Indian Trusts Act, 1888-or any Trade Union registered un |

Trade Unions Act or any employees’, association or any body ‘of persons, whether |

incorporated or not; . | - |

(f) any outfit or frontal or other organization of a Political Party, whether

recognized or not. |

(g) any person who is not government servant, or who 1s allotted the Public |

Premises by virtue of his being office bearer or representative of a Society, Trust or

any body of persons, whether incorporated or not.”

STATEMENT OF OBJECTS AND REASONS

The Estate Department of the State Government is the manager of certain public premises, which

are under occupation of various classes of ineligible persons. The said premises are needed for public

purpose and the State Government is of the opinion that in view of the acute shortage of public premises,

the said public purpose is not being fulfilled.

Since the State Government is under an obligation to provide suitable accommodation and

- offices to several classes of eligible persons and organization and the procedure for eviction prescribed

under the Uttar Pradesh Public Premises (Eviction of Unauthorized Occupants) Act, 1972 is cumbersome

and time consuming and is not appropriate for centain classes of building/occupants, it has become

necessary for State Government to get such public premises as are occupied by the persons/organisations |

not eligible for such occupation be vacated to fulfill the said obligation. °

2. Keeping in view of the above problem it has been considered expedient to ex¢lude such Public

Premises as are under the administrative control of the Estate Department and which are in occupation of

non-official, non-governmental organisations, trusts, political parties etc., from the purview of the Uttar

Pradesh Public Premises (Eviction of unauthorised occupants) Act, 1972 (U.P. Act No. XXII of 1972) and

to take necessary action to evict unauthorised occupants. It has, therefore, been decided to amend the said

Act to provide for the exclusion of the residential premises allotted to Ministers, Members of Parliament,

Legislatures, non-governmental organisation, trusts, non-officials, political parties and such other persons

who do not come in the field of eligibility. |

The Uttar Pradesh Public Premises (Eviction of Unauthorised Occupants) (Amendment) Bill,
