The Art of living amongst Art

An old Lisbon house, overlooking the beautiful garden of Príncipe Real, the Tejo River, São Jorge Castle...

At the entrance we discover wonderful drawings, paintings and objects leaning against the walls, a picture that continues across the rooms, where the passionate collector has received visitors from all over the world until very recently.

His collection reunites former residences from Hamburg, Paris, New York.

There are collectors who focus on a specific area or who decorate their home with beautiful things, but also those, such as this multilingual cosmopolitan, who cannot resist something which appeals to them.

And lots of things appealed to this collector!

A magnificent pair of ormolu candelabra (lot 8), bought 30 years ago in one of Paris most prestigious galleries, or a beautiful “Ecce Homo” attributed to Carlo Dolci (lot 114), from an important Italian collection – just two of the items from this idiosyncratic collection, all acquired with playful joy and great connoisseurship over the course of more than 40 years!

It is a pleasure to us to be able to pass on this collection to new collectors!

CONDIÇÕES NEGOCIAIS

A Renascimento - Avaliações e Leilões S.A., matriculada na Conservatória do Registo Comercial de Lisboa com o número 508229782, com o capital social de €151.000,00, com sede na Av. Alvares Cabral, 35, 1250-015 Lisboa, abaixo identificada por “Renascimento”, no exercício da sua actividade de leiloeira rege-se pelas seguintes condições:

CONDIÇÕES DE COMPRA DE BENS EM LEILÃO:

1- Para ser considerado comprador ou potencial comprador, torna-se necessário antes do início do leilão o registo no qual devem constar obrigatoriamente o nome, a morada, números de telefone, Bilhete de Identidade e contribuinte,podendo a “Renascimento” solicitar a apresentação de um original de um documento de identificação válido. Aassinatura desse registo pressupõe o conhecimento e aceitação das presentes condições negociais.2- A “Renascimento” considera que o potencial comprador actua em seu nome pessoal, salvo se o fizer na qualidadede mandatário de outrem, caso em que se exige uma procuração juridicamente válida para o efeito. 3- Uma garantia de pagamento, tanto quanto à forma como quanto ao montante, poderá ser solicitada a qualquermomento, pela “Renascimento” a qualquer potencial comprador.4- A “Renascimento” reserva-se ao direito de recusar a admissão, presença ou inscrição no leilão bem como ignorarqualquer lance, designadamente a quem não tiver pontualmente cumprido obrigações de: pagamento elevantamento dos bens comprados em leilões anteriores. 5- Licitação por escrito:A “Renascimento”, caso o potencial comprador não possa estar presente no leilão, poderá licitar em seu nome desdeque o seja expressamente solicitado através de impresso próprio devidamente preenchido nos termos das condições dele constantes, com uma antecedência de duas horas do inicio da sessão a que respeita.Licitação por telefone:Sempre que um dos potenciais compradores o deseje, deverá solicitá-lo previamente por escrito indicando quais osbens que pretende licitar, assim como indicar os números através dos quais pretende ser contactado com umaantecedência de duas horas do inicio da sessão a que respeita. Uma ordem de licitação telefónica implica que opotencial comprador se obriga, no mínimo, a cobrir o valor de reserva indicado no catálogo. Não sendo possível, porqualquer motivo, estabelecer contacto telefónico com o potencial comprador, a “Renascimento” reserva-se ao direito de licitar em seu nome pelo valor mínimo do catálogo os lotes em questão.6- A “Renascimento” considera como comprador o registado que arremate o bem pelo valor mais elevado, devendo opregoeiro decidir, com total poder discricionário, qualquer dúvida que ocorra durante o leilão, podendo retirar ouvoltar a pôr em praça qualquer lote.7- A “Renascimento” não poderá actuar em seu próprio nome como compradora dos bens apresentados em leilão.

PAGAMENTOS E LEVANTAMENTOS

8- Sobre o valor total da arrematação acresce uma comissão a favor da “Renascimento” correspondente a 15% + I.V.A. à taxa em vigor. 9- O comprador obriga-se, no prazo de cinco dias úteis à data da respectiva compra, proceder ao pagamento, conformeo previsto no artigo 8º, assim como a levantar o bem, podendo ser exigido no acto da compra, um sinal não inferior a30% do valor da mesma. Findo esse prazo a “Renascimento” reserva-se ao direito de cobrar juros à taxa legal em vigorpara as operações comerciais. 10- A titularidade sobre bem só passará a ser do comprador após paga na quantia total da venda em numerário,cheque visado ou transferência bancária. Caso o pagamento seja efectuado através de cheque não visado, e mesmoque o bem já se encontre em posse do comprador, só se considera liquidada a quantia total de venda após boacobrança. Até lá o bem permanecerá propriedade do vendedor.11- Qualquer bem só poderá ser levantado depois do pagamento integral da quantia em dívida. 12- O comprador deverá à sua custa e responsabilidade diligenciar o manuseamento, embalamento, levantamento etransporte dos bens adquiridos, no prazo de cinco dias úteis após a compra, depois de cumprido o disposto no artigo 11º. A ajuda prestada pelos representantes, colaboradores ou trabalhadores da “Renascimento” será feita a título decortesia, pelo que não lhes poderá ser atribuída qualquer tipo de responsabilidade por qualquer dano ocorrido.13- Se o comprador não efectuar o levantamento do bem adquirido no prazo de cinco dias úteis contados da data darespectiva compra, ficará responsável pela perda ou dano, incluindo furto ou roubo, que possa ocorrer no bem,mesmo que os mesmos sejam provocados por negligência ou outra causa pela “Renascimento”. 14- Caso o bem esteja parcial ou totalmente pago mas não levantado dentro do prazo previsto no artigo 13º e severifique uma perda ou dano do bem, incluindo furto ou roubo, apenas confere ao comprador o direito a receberquantia paga até esse momento pelo bem, não tendo direito a qualquer compensação, indemnização ou juros.15- Se o comprador não efectuar a liquidação do montante total em dívida ou ao levantamento do bem, no prazo de

21 dias a contar da data da arrematação do mesmo, a “Renascimento” poderá, a todo tempo e sem que o comprador possa exigir quaisquer compensação ou indemnizações por tal facto: a) Intentar acção judicial para obter a cobrança da quantia total em dívida; b) Sem prejuízo do direito da “Renascimento” receber a comissão devida pelo comprador e da consequentepossibilidade de ser intentada acção judicial para cobrança desta, notificar este da anulação da venda; c) Cobrar juros de mora à taxa legal em vigor sobre o montante em dívida a partir do 22º dia até à data da liquidaçãototal do montante em dívida; d) Fazer a retenção de quaisquer bens vendidos ao comprador em falta no leilão emcausa, ou noutro, e disponibiliza-los apenas e após o pagamento integral do montante em dívida; e) Actuar em conformidade com o artigo 4ª das presentes condições;f) Tomar qualquer tipo de medidas que em dado momento se mostrem adequadas à obtenção do pagamento totalou parcial da dívida do comprador em falta assim como a retenção de algum bem, seja a que título for, que seencontre em posse da “Renascimento”. 16- As situações previstas nas alíneas anteriores não prejudicam o direito da “Renascimento” reclamar o pagamentode juros de mora, despesas de remoção, embalamento, armazenamento, transporte e/ou seguro do bem a que hajalugar.17- O Comprador faltoso que não tenha levantado o bem adquirido, apesar de o ter pago, será o único responsávelpor todos os custos a que haja lugar com o manuseamento, o embalamento, a remoção, transporte, armazenamento e seguro do mesmo ficando a decisão se o armazenamento será efectuado em armazéns próprios ou noutros aocritério da “Renascimento”.18- Os bens levados à praça serão arrematados nos locais e estado em que se encontrem, sendo da responsabilidadedos potenciais compradores analisá-los durante a exposição pública dos mesmos, que se realiza nos dias anterioresao leilão, nomeadamente o rigor da descrição constante no catálogo quanto a eventuais restauros, defeitos, faltas eimperfeições.19- Se o comprador formalizar a pretensão de rescisão do contrato implícito de compra e venda antes do pagamento do bem ao vendedor com o prévio acordo e concordância da “Renascimento”, pode a mesma rescindi-lo devolvendo ao comprador os montantes recebidos referentes ao bem em causa. 20- As fotografias, ilustrações ou representações de qualquer bem no catálogo ou na interntet têm por fim exclusivoa identificação do mesmo sujeito a venda. 21- Não existe qualquer tipo de responsabilidade por parte da “Renascimento” perante qualquer comprador de umbem que venha a ser impedido de sair do país ao abrigo da legislação de protecção do património cultural,independentemente da data em que haja sido efectivada a respectiva inventariação, arrolamento ou classificação,devendo o comprador que se dinta lesado reivindicar os seus hipotéticos prejuízos directamente ao vendedor ou aoterceiro causador. 22- Qualquer situação não prevista nas presentes condições, a eventual responsabilidade da “Renascimento” ficarásempre limitada ao valor total e em singelo pago pelo bem adquirido.

CONDIÇÕES DE VENDA DE BENS EM LEILÃO

Contrato de prestação de serviços

23- Qualquer bem posto em leilão não é propriedade da “Renascimento”, limitando-se esta a intermediar a suavenda.24- A partir do momento em que um vendedor e a “Renascimento” assinem um contrato de prestação de serviços,ficam ambos vinculados ao referido contrato.25- Elementos que devem constar no contrato:a) Identificação completa do vendedor (nome, morada, telefones, números de contribuinte e de Bilhete deIdentidade) e, se for o caso, do seu representante;b) Descrição sumária do bem; c) Preço mínimo de venda do bem acordado entre as partes (valor de reserva); d) Comissão a pagar pelo vendedor à “Renascimento” pela prestação de serviços; e) Assinatura do vendedor ou seu representante legal com poderes para o acto, declarando conhecer, concordar eaceitar as presentes condições negociais e outras a que haja lugar.26- Garantias implícitas dadas pelo vendedor à “Renascimento” ao celebrar o contarto de prestação de serviços: a) Tem que garantir ser o proprietário e legítimo possuidor do bem que pretende entregar para leilão, reservando-sea “Renascimento” ao direito de solicitar a apresentação de documentos que comprovem a propriedade do mesmo,ou sendo um representante legal do proprietário, autorizado por este a vender o bem, apresentar para o efeitodocumentos que corroborem esta relação, devendo em qualquer caso informar expressamente sobre a eventualinventariação ou arrolamento do bem pelas entidades oficiais; b) Tem que garantir que não tem conhecimento de qualquer informação susceptível de poder alterar a vontade da“Renascimento” em contratar nos termos em que a fez;c) Tem que garantir que, após a assinatura do contrato de prestação de serviços, coloca o bem ou bens em causa à

disposição da “Renascimento” e do comprador; d) No caso de o vendedor solicitar o cancelamento da venda de algum bem incluído no contrato a “Renascimento”reserva-se o direito de cobrar uma taxa de serviços correspondente à comissão acordada; e) O vendedor assume a obrigação de indemnização à “Renascimento” bem como o comprador por qualquer danoou prejuízo que sofram em virtude do incumprimento de alguma das condições negociais presentes.

27- Sempre que o entender, a “Renascimento” poderá, a todo o tempo, efectuar ou mandar efectuar exames e/ouperitagens ao bem de forma a confirmar a respectiva descrição: a) Se através de tais exames ou peritagens se concluir que o contrato de prestação de serviços não se encontra materialmente correcto, poderá a “Renascimento” denunciá-lo ou resolvê-lo; b) Caso se verifique que o vendedor actuou com dolo o negligência grosseira na negociação e celebração do contrato, este deverá indemnizar a “Renascimento” por qualquer tipo de danos e/ou prejuízos que a mesma tenha sofrido, incluindo dano de imagem no caso da venda do bem já ter sido publicitada;c) O contrato de prestação de serviços poderá ainda ser denunciado ou resolvido pela “Renascimento” sem direito a qualquer tipo de indemnização por parte do vendedor, caso tais exames e/ou peritagens não se revelem esclarecedores, como ainda se subsistirem fortes dúvidas sobre a correcção material do contrato. 28- Após o vendedor e a “Renascimento” assinarem o respectivo contrato de prestação de serviços, a “Renascimento”fica expressamente autorizado a fotografar, publicitar, publicar e utilizar sob qualquer forma e para todos os fins, aimagem e a descrição de todos os bens constantes do referido contrato.29- Só por mútuo acordo pode ser alterado o contrato de prestação de serviços, sem prejuízo de no catálogo ondevenha a ser incluído o bem, a “Renascimento” poder alterar a sua descrição. 30- A “Renascimento” pode ainda estabelecer livremente o número de bens a colocar em cada lote.

RESPONSABILIDADES DO VENDEDOR

31- O vendedor deverá à sua custa e responsabilidade diligenciar o manuseamento, embalamento e transporte dosbens para entrega nas instalações da “Renascimento”, bem como o seu posterior manuseamento, embalamento,levantamento e transporte em caso de não venda. Em ambos os casos (entrega e levantamento) deverão conferidospela entidade receptadora se o estado de conservação dos bens confere com a descrição; a) Qualquer ajuda prestada nestes actos pela “Renascimento” deve ser considerada a título de cortesia, não podendodecorrer dessa ajuda qualquer tipo de responsabilização, ainda que haja danos provocados por negligência;b) A eventual indicação ou sugestão de uma empresa e/ou pessoa singular para fazerem qualquer um dos actosmencionados neste artigo exclui qualquer tipo de responsabilidade da “Renascimento” por quaisquer danos ouprejuízos decorrentes desses serviços. 32- São da exclusiva responsabilidade do vendedor, após a assinatura do contrato de prestação de serviços com a“Renascimento”, todos e quaisquer tipos de danos ou perdas, incluindo roubo ou furto que surjam no bem ouobjecto do mesmo e que ainda se encontre na posse do vendedor, podendo este ter que indemnizar a“Renascimento” por danos ou perdas. 33- A “Renascimento” apenas se responsabiliza pelos bens que estejam depositados nas suas instalações desde que orespectivo contrato de prestação de serviços esteja devidamente assinado pelas partes, com seguro incluído, ou queos bens lhe tenham sido formalmente confiados para efeitos de estudo.34- Qualquer responsabilidade da “Renascimento” por eventuais perdas ou danos, incluindo furto ou roubo, quepossam ocorrer em bens que lhe tenham sido formalmente confiados, nos termos do artigo anterior, encontra-secoberta pelo valor da reserva acordada.

PAGAMENTO

35- Ao montante total da arrematação do bem, o vendedor autoriza expressamente a “Renascimento” a deduzir acomissão que lhe é devida nos termos contratuais, acrescida de I.V.A. à taxa legal em vigor e o valor dos serviços eoutros pagamentos devidos nos termos contratuais, acrescidos também de I.V.A. à taxa legal em vigor.36- Após a venda de um bem e recebida do comprador a totalidade da venda, a “Renascimento” obriga-se a entregarao vendedor a quantia da venda, deduzida das comissões, serviços e impostos que foram devidos 30 dias após a datada realização da última sessão do respectivo leilão devendo ser o vendedor a contactar a “Renascimento”. 37- No caso do bem vendido constituir uma obra de arte original que não seja de arquitectura ou de arte aplicada, oautor da obra ou os seus herdeiros a título de direito, conforme o artigo 54º do código de Direito de Autor e dosdireitos conexos (na redacção dada pela lei nº 24/2006, de 30 de Junho), têm direito a uma participação livre deimpostos sobre o preço obtido na venda:a) Também nos termos do mesmo artigo o pagamento da participação acima referida é da total responsabilidade dovendedor da obra de arte original, pelo que o vendedor se compromete a entregar ao autor da obra ou seus direitosa título de direito de sequência ou a quem validamente os represente, a quantia respectiva que tiver lugar; b) No caso do autor da obra original ou seus herdeiros contactarem a “Renascimento” com este intuito, a mesmainformará o autor dos resultados da venda assim como da identificação e dados para contacto com o vendedor, por

forma que o autor possa exercer o seu direito legal. O vendedor autoriza expressamente a divulgação dos seus dados pessoais para este efeito. c) A participação referida no mesmo artigo determina que a mesma nunca exceda o valor de €12500, sendo calculadada seguinte forma: I- preço compreendido entre €3000 e €50000, participação do autor 4% sobre o preço de venda;II-preço compreendido entre €50.000,01 e €200.000,00, participação do autor 3% sobre o preço de venda;III- preço compreendido entre €200.000,01 e €350.000,00, participação do autor 1% sobre o preço de venda;IV- preço compreendido entre €350.000,01 e €500.000,00, participação do autor 0,5% sobre o preço de venda;V- Preço superior a €500.000,01 participação do autor de 0,25% sobre o preço de venda. Como excepção ao dispostonos dois parágrafos anteriores, e no caso do autor, seus herdeiros ou quem validamente os representar, solicitar talpagamento à “Renascimento” antes de esta ter efectuado o pagamento ao vendedor, o vendedor autorizaexpressamente a “Renascimento” a deduzir o montante liquido do valor a receber.38- Sempre que qualquer vendedor efectue também qualquer compra no leilão, este autoriza expressamente a“Renascimento” a deduzir ao montante liquido que lhe era devido nos termos do artigo 35º as quantias por este apagar enquanto comprador.39- Se após o decurso do prazo referido no artigo 36º a “Renascimento” não tiver recebido o valor total da venda,deverá informar o vendedor desse facto, como ainda de que intentou ou pretende intentar acção judicial para obtercobrança da quantia total em dívida ou de que vai requerer anulação à venda nos termos e conforme o previsto noartigo 16º. a) Sempre que na atitude a tomar contra o comprador seja necessária a intervenção do vendedor, deverá o mesmomandatar a “Renascimento” para esse efeito; b) Caso a “Renascimento” consiga obter êxito na cobrança da dívida, quer pela forma judicial quer pela formaextrajudicial, deverá entregar o valor devido ao vendedor nos cinco dias úteis subsequentes à cobrança efectuada. 40- Em caso algum poderá a “Renascimento” ser responsabilizada por qualquer vendedor pela falta de pagamentoou desistência de algum comprador relativamente a quaisquer lotes arrematados em leilão.

NÃO VENDA DE UM BEM

41- Se um vendedor pretender que um bem que não tenha sido vendido em leilão não seja vendido pelo preço dereserva acordado nos 20 dias úteis seguintes ao término do leilão, deverá comunicá-lo expressamente à“Renascimento”.42- Decorrido o prazo previsto no artigo anterior ou outro mais extenso quando acordado entre as partes, e casonão se tenha efectuado a venda do bem, a “Renascimento” deverá comunicar esse facto ao vendedor para que estepague à “Renascimento” o que estiver estipulado e previsto no contrato de prestação de serviços e proceda aolevantamento do mesmo nos 5 dias úteis posteriores a contar da data da comunicação. Decorrido este prazo semque o vendedor tenha levantado o bem, ficará este responsável por qualquer dano incluindo furto ou roubo, nãopodendo desde essa data pedir qualquer tipo de responsabilidades à “Renascimento”. Decorrido o prazoestabelecido neste artigo, todas as despesas são da responsabilidade do vendedor (seguro, armazenamento,embalamento, etc.).43- Passados 90 dias sobre a comunicação referida no artigo anterior, e sem que haja qualquer resposta formal dovendedor, a “Renascimento” poderá vender o bem em leilão sem sujeição ao preço mínimo de venda acordado,recebendo a comissão e as taxas fixadas no contrato de prestação de serviços, tendo ainda direito a deduzir todas asquantias em divida pelo vendedor.

CONDIÇÕES GERAIS

44- Os compradores e os vendedores esclarecida e expressamente autorizam o processamento dos seus dadospessoais.45- Para a resolução de qualquer conflito entre as partes será competente o foro da comarca de Lisboa, com expressa renúncia a qualquer outro.
